Terms & Conditions

 

Agreement to Terms

 

 

By placing an order and submitting payment, you confirm that you have read, understood, and agreed to all terms and conditions outlined by Tony’s Cakes LLC. This agreement constitutes a binding contract.

 

 

Non-Refundable Policy Due to Sanitation

 

 

For health and safety reasons, we do not accept returns or exchanges on custom or perishable items, including cakes, once the order has been fulfilled and delivered or picked up. All sales are final upon receipt of the product.

 

Payments

 

 

All payments are non-refundable. Store credit may be issued only if an error is made by Tony’s Cakes LLC. Requests for refunds or store credit must be submitted in writing via email and will be reviewed within 48 hours. Deposits are non-refundable and non-transferable.

 

Booking & Deposits

 

 

All appointments must be booked in advance. A 50% deposit is required to secure your order. Final payments are due three days before pickup or delivery. Late payments incur a 15% fee per day.

 

Order Changes

 

 

Changes to size, flavor, or design must be submitted in writing via email. Changes via phone, social media, or text will not be accepted. A $25 change fee may apply.

 

 

Late Pickups

 

 

Please notify us at least 30 minutes prior if you expect to be late. A $10 late fee applies for delays under 1 hour; $20 for delays of 1–2 hours; and $40 for delays beyond 2 hours. Cakes will not be released until late fees are paid.

 

 

Last Minute Orders

 

 

Orders placed less than one week in advance will incur a $30 rush fee. Full payment is due upon booking.

 

 

Design Variations

 

 

While we strive to meet your expectations, slight variations in design, color, or size may occur. Exact replicas are not guaranteed.

 

 

Color Matching

 

 

Due to differences in materials and screen displays, exact color matches cannot be guaranteed. Providing physical color swatches 14 days prior to your event is recommended.

 

 

Third-Party Pickup or Delivery Waiver

 

 

If you arrange for a third party (courier, friend, Uber, etc.) to pick up or receive your order, you accept full responsibility upon handoff. Tony’s Cakes LLC is not liable for damages occurring after this point.

 

Delivery Acceptance

 

 

Upon delivery, the recipient is responsible for inspecting the product. Acceptance constitutes confirmation of satisfaction with the order.

 

 

Dispute Waiver

 

 

You agree to resolve any dissatisfaction directly with Tony’s Cakes LLC before initiating chargebacks or disputes. Unauthorized chargebacks may result in forfeiture of future services.

 

 

Photos & Proof of Fulfillment

 

 

All custom orders are photographed before pickup or delivery and these images may be used to verify fulfillment and resolve disputes.

 

 

Digital Signature Consent

 

 

Your typed or electronic signature is legally binding under the E-SIGN Act.

 

 

Liability & Allergens

 

 

Tony’s Cakes LLC is not liable for allergic reactions. Products may contain allergens such as milk, wheat, nuts, and soy. It is your responsibility to inform guests.

 

Cancellations

 

 

Cancellations must be submitted at least 48 hours in advance and will be issued as store credit only.

 

Contract Scope

 

Only items explicitly listed on the invoice are guaranteed. Verbal agreements or assumptions are not 

Policy Changes

 

 

Tony’s Cakes LLC reserves the right to modify, update, or change these Terms and Conditions at any time without prior notice. It is the customer’s responsibility to review the most current policies posted on our website before placing an order. Continued use of our services after changes constitute acceptance of the updated terms.
